A certified translation is done by a person who carries the designation of “Certified Translator,” which is granted by authorized provincial (Canada) and federal (U.S.) associations. Many professional translation agencies employ certified translators to ensure accuracy and official acceptance. On the other hand, a Notarized Translation can be done by both a certified translator and a non-certified translator. In many cases, a certified translation provided by a reputable translation agency is sufficient enough to appease officials, and there is no need to get the document notarized or sworn with an affidavit because the certified translator’s seal and declaration are acceptable.
Yes, they will be. Certified translations are accepted by all Government of Canada departments such as Passport Canada, IRRC and CRA as well as Provincial Registries. Organizations such as IQAS and other academic institutions also recognize certified translations.
There are times when a certified translation is enough for countries outside of Canada. However, you should consult with your Embassy or Consulate prior to submitting your final documentation. It is often the case that an Embassy will require a notarized translation in addition to certification by the translator.
In the vast majority of cases, yes. In Quebec, Ontario, and BC, all documents translated by a certified translator are accepted in the courts as there is legislation written in regards to the use of certified translators. In other provinces such as Alberta, and in specific types of law such as Wills and Estates Law, the outdated legislation doesn’t recognize certified translations and a notarization must accompany the translation; It also must be commissioned or notarized by someone in the province where the will is being processed/validated. In the vast majority of scenarios, however, certified translations are preferred and are considered more desirable and more reliable than a translation that is simply notarized only with no certified translator’s declaration.
